The type of personal information we collect

We currently collect and process the following information:

  • Personal identifiers, contacts and characteristics (for example, name and contact details)
  • Ethnicity
  • Your health and medical condition/s for the purpose of continuing effective quality care
  • Your employment or other socio-economic factors affecting your health, medical care, and/or application for employment within the PCN
 

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • You are registered with one of the above GP surgeries
  • You are in the process of referral to a consultant/ specialist or other third-party organisation who will request your consent to share your information and will require this to continue your care
  • You are applying for a role within the Primary care network or one of the surgeries within the network

We also receive personal information indirectly, from the following sources in the following scenarios:

  • If you are applying for a role within the network then we may receive personal information from a referee.
  • If you apply for a role through a social network or share your social media handles

We use the information that you have given us in order to provide you with safe care and treatment. We will also use your information so that the practice can check and review the quality of the care they provide. This helps us to improve our services to you.

We will share relevant information from your medical record with other health or social care staff or organisations when they provide you with care. For example, your GP will share information when they refer you to a specialist in a hospital. Or your GP will send details about your prescription to your chosen pharmacy.

Healthcare staff working in A&E and out-of-hours care will also have access to your information. For example, it is important that staff who are treating you in an emergency know if you have any allergic reactions. This will involve the use of your Summary Care Record [OR Emergency Care Summary / Individual Health Record]. You have the right to object to information being shared for your own care. Please speak to the practice if you wish to object. You also have the right to have any mistakes or errors corrected.

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

(a) Your consent. You are able to remove your consent at any time. You can do this by contacting your GP surgery on the above telephone number/s.

(b) We have a contractual obligation.

(c) We have a legal obligation.

(d) We have a vital interest.

(e) We need it to perform a public task.

We will collect your personal information from registration forms that you personally complete. This may be in the application of joining one of the surgeries, or it may be in relation to a job application.

We need to collect this information for you to consent to us holding your data and/or if you are intending to enter into a contract with the practice and/or PCN.

Any information passed on to a third party will be with your prior verbal or written consent because of onward referral for the benefit of your personal medical care.

You have the right to withdraw consent at any time and you should do this through your practice or through the LMN management team; kmicb.lmn.pcn@nhs.net

How we store your personal information

Your information is securely stored.

We keep medical records on a secure clinical system which is only accessed via professionals working for the practice. Medical health records are kept for 10 years after death by Primary care support England.

We keep job applications and your CV, if necessary, on a secure system accessed only by the relevant managers and employer. We will hold unsuccessful applicant data for 6 months unless you consent in writing for us to hold your CV for future opportunities. Employees will have a personal file for up to 6 years after their employment end date. The information held on a patient or employee with be deleted from the system after this period.

 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information.

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Your rights

Under the Data Protection Act 2018, you have the right to find out what information the government and other organisations store about you. These include the right to:

  • be informed about how your data is being used
  • access personal data
  • have incorrect data updated
  • have data erased
  • stop or restrict the processing of your data
  • data portability (allowing you to get and reuse your data for different services)
  • object to how your data is processed in certain circumstances

You also have rights when an organisation is using your personal data for:

  • automated decision-making processes (without human involvement)
  • profiling, for example, to predict your behaviour or interests
